ATTENDEE AND PARTICIPANTS LIKENESS RELEASE AND WAIVER
Thank you for attending Heart Of Hollywood Motion Pictures (Heart Of Hollywood) Virtual Red Carpet Event! We will be taking photos, recording videos, or both at the Event (that is, creating the “Content” as defined below), and will use the Content in Heart Of Hollywood Motion Pictures advertising, marketing, and promotional materials. Please read the following.By this Release: I understand that Heart Of Hollywood Motion Pictures will rely on my indication below whether I agree or do not agree to the grant of rights and releases provided in this Release. I agree that I will not have the right to stop or enjoin the publication or use of any Content or to rescind any rights granted to Heart Of Hollywood Motion Pictures in this Release. 1. I grant to Heart Of Hollywood Motion Pictures an unrestricted and unlimited LICENSE, that is, an unrestricted, sublicenseable, assignable, irrevocable, perpetual, worldwide, royalty-free license; 2. To CAPTURE my image and voice, that is, my voice, image, persona, likeness, performance, and materials as they appear in any still image, photo, audio, visual, and audiovisual recordings, taken of me, by or on behalf of Heart Of Hollywood Motion Pictures (collectively, the “Content”); and 3. To CREATE NEW AND DIFFERENT WORKS that include the Content, that is, to reproduce, modify, create derivative works of, and otherwise use the Content or derivative works, in whole or in part, in any manner including in combination with any other material, in any format or media, whether now existing or hereafter devised; and 4. To DISPLAY the Content, that is, to publish, publicly display, publicly perform, distribute (directly or indirectly), transmit, or broadcast the Content; and 5. To USE MY NAME, voice, likeness, and biographical information, whether in original or modified form, in connection with the Content; in 6. All MEDIA, that is, in any and all media and by any means, whether now known or hereafter devised.I waive any right that I may have to inspect or approve any Content before publication. I waive all rights of privacy, publicity, or any other rights of a similar nature in connection with the Content, or any portion of it, including, without limitation, my name and likeness, or any advertising or publicity. I expressly release Heart Of Hollywood Motion Pictures from all claims, demands, liabilities, or causes of action whether now known or unknown, for defamation, trademark or copyright infringement, violation of moral right, and invasion of the rights to privacy, publicity, or personality or any similar matter, or based upon or relating to the use and exploitation of the Content. I warrant that I am over the age of 18 and I am fully authorized to grant the rights granted in this Release. I agree that Heart Of Hollywood Motion Pictures is under no obligation to use, distribute, exhibit, or exploit the Content. This Release is subject to California law, without reference to conflict of law principles. All disputes under this Release shall be resolved in the State and Federal Courts of Los Angeles County, CA. If any provision of this Release is deemed not enforceable, such provision shall be deemed modified to the least extent necessary to render it enforceable and the remainder of this Release shall continue in full force and effect.
